Diagnosis: acrostichal 0:1; dorsocentral 2:4; mid femur with three preapical setae; wing hyaline; male: intra-alars 2; katepisternum with dark setulae on posteroventral surface.

Color: general body coloration brown; frons dark yellow, apex darkened; facialia and parafacialia yellow; gena brown; antenna and palpus yellow; scutum dark brown with grey pruinosity; humeral callus and apex of scutellum brown; median and hind femora apex dark brown; calypters and halter yellow; wing hyaline.

Male. Length. Body: 5.0– 5.3 mm; wing: 5.8–5.9 mm.

Head: eyes separated from each other by 0.08–0.11 mm, at level of ocellar tubercle; 12–13 pairs of frontal setae; ocellar seta large and parallel; postocellar seta large and divergent; inner vertical seta small and convergent; outer vertical seta small and divergent.

Thorax: acrostichal 0:1; dorsocentral 2:4; intra-alar 1; fore tibia with a distinct submedian anterodorsal setae; apex of fore tibia with setae on dorsal, posterodorsal and posteroventral surfaces; mid femur with a row of setae on posteroventral surface from base to middle; mid femur with three preapical setae, on dorsal, posterodorsal and posterior surfaces; apex of mid tibia with setae on anterior, dorsal, posterodorsal, posterior, posteroventral, ventral and anteroventral surfaces; hind femur with a complete row of dorsal, posteroventral and anteroventral setae; hind femur with many distinct anterodorsal setae, not ordered in a row, extending from base to middle; hind tibia with one median anterodorsal seta and three median anteroventral setae; hind tibia with a anterior, anterodorsal, dorsal, posterodorsal, ventral and anteroventral setae at apex; wing with one dorsal and two ventral setae at apex of stem vein.

Abdomen: epandrium slightly flattened, in posterior view.

Female (differing as follows): Length. Body: 5.2–5.5 mm; wing: 5.8–5.9 mm; eyes separated from each other by 0.3–0.33 mm, at level of ocellar tubercle; 9–10 pairs of frontal convergent setae, except for upper two pairs, which are parallel; ocellar and postocellar setae large and divergent; inner vertical seta large and convergent, and outer vertical seta large and divergent; intra-alars 2; sternite VIII with strong spike-like setae; epiproct with four setae, setae in a square-shaped arrangement (2:2).

Comments: Snyder (1949) described N. instabilis believing that it could be a synonym of N. stabilis (Stein) . However, examination of the paratype of N. instabilis and the holotype of N. stabilis showed that the two species are distinct. Neomuscina instabilis has a much softer coloration, males with intra-alars 2, proepimeron and proepisternum without dark setulae. In N. instabilis males have a characteristic epandrium slightly flattened and females have sternite VIII with strong spike-like setae.
